Challenges – legal and social – to dealing with secondary occupation in the framework of land restitution.
General Description:
In this strand we seek to broaden perspectives on secondary occupation, relating it to other questions, such as territorial reconfiguration and changes in the use of soil.
We will discuss the conceptual and legal challenges which arise from the land restitution process, the type of affirmative measures advanced by the State in respect of secondary occupiers, and proposals for creative alternatives: collective solutions based on strengthening the capacity for self-management of those who have had land restored to them as well as the community of secondary occupiers. We also seek to highlight the most interesting experiences internationally in terms of how to deal with secondary occupation.
